Remember that student chat transcripts in Spaces are themselves education records: the district, not the teacher, needs to govern who can access them and how long the vendor keeps them.
How does COPPA apply to SchoolAI?
Because under-13 students interact with the AI directly, COPPA applies with full force. Schools can consent in place of parents only for use that is educational and school-authorized — which presumes the school actually authorized it via an agreement. A teacher running a free-account Space for a grade 4 class has collected under-13 chat data through a vendor relationship nobody consented to, which is the exact gap districts should close with a DPA and a consent or notice process.
Our district hasn't approved SchoolAI — does that mean students aren't using it?
